I am not surprised but could be one of those situations where this NSA 'flaw' had been discovered in the wild and M$ took the blame. You can do things in the open and no one blinks an eye.
Perhaps of interest, the FreeBSD Project during their FOSDEM 2014 Summit had Poul-Henning Kamp (FreeBSD developer) present how the NSA 'engineer' various surveillance vectors.
